52. and well vested in the person and persons so to
be respectively nominated jointly with the Sur-
vivors or Survivor of the said former Feoffees and
Trustees if any such shall be living and to and in
their heirs To the Intent and purpose that they
and their heirs may stand seized thereof upon
the several Trusts and subject to and by and
under the several Conditions Provisoes Declarations
and Agreements herein expressed or so much
thereof as shall then be undetermined and capable
of being performed And it is hereby declared
that the number of the said Trustees and Feoffees
shall never hereafter exceed and be more than
three persons together at any one time for the
time being And the said Trustees and Feoffees
for the time being shall not wittingly or willingly
at any time hereafter remain and continue inferior
then or below the Number of three Persons
for above the space of three callendar Months
for the time being Anything herein before
contained to the contrary notwithstanding
Provided always nevertheless And it
is hereby also declared and agreed by and between
all the Parties to these Presents that it shall and
may be lawful to and for the said James Duke
of Atholl from time to time and at all times
hereafter during his Life by any Deed or
Instrument
