At a meeting of the 24 Keys in Castletown
the 13^th day of July 1768

We the Keys of Mann now assembled having in pursuance of his Excellency
the Governors order proceeded to hear and determine a certain Cause or Action
wherein John Swanson Catherina his Plaintiff and Nich Brookins and Catherine
Brookins otherwise Kennedy his wife William Tarrant and John Lishild[?] of
Ramsey Merchant and Deft^s for a parcel of Quarterlands in the Parish of
K.K. Malew of Seven Shillings Rent formerly in the Names of Bradly Corage &
the Simer Close formerly parcel of the Intack of Ballacork also a parcel of
Antient Intack Land of the Annual Lords Rent of five pence or thereabouts
also a Cottage House thereunder & appurtenances at or near Kn Malew
Bridge called Kennedy house of fourpence Intack Rent and a penny Intack Lord
And Inclusive of a Cottage Rent together with the Rents Issues and profitts of
all and singular the said Lands & premisses for diverse years past and down
and by the said Action Dated the May day of May 1759 and moreover
fully appear and we having perused & considered the pleading & Traverse
Jurys Verdicts with the several positions, ~~[illegible]~~ ~~[illegible]~~
& accidents of proceedings with what was otherwise offer'd and argued by
the parties and their Council in this Cause. Do upon due and deliberate
consideration the whole Are and are of Opinion that the Traverse
Jury proceeded Legal in the year 1762 and affirm the said Traverse Jurys
Verdict which bears date the 21^st day of October 1765 in regard it appears to
us that the said parcel of Quarter land called Bradly Corage & Simer Close
of Seven Shillings Lords Rent was formerly purchased by one David Kennedy
and Mary Thomas his wife and they having dyed intestate the Right and
property thereof thereby descended in course of Inheritance ~~to their is~~[?] to
to their Eldest Son James who having dyed and it being said David
Kennedys their other Son who in like Manner Dyed without making a legal
Disposition thereof it then ~~descended~~ descended on the Right & Inheritance of
Catherine Brookins alias Kennedy their Eldest Sister one of the Defend^ts in this
cause and the said Catherine Brookins with the other Defend^t Nich Brookins
her husband having by Deed dated the 7 August 1753 granted & conveyed the
said premises of Bradly Corage & Simer Close and other things to the
Plaintif John Swanson Wherefore we order and decree him the said
Plaintif the Right and property of the said parcell of Quarterland called
Bradly Corage & Simer Close of Seven Shillings Lords Rent, and that
he ought to be lett into the possession thereof. And yet Nevertheless to the Mortgage
or Incumbrance made by Mary Kennedy to the Defend^t William Tarrant
for the consideration of fifty pounds, Acknowledged & signed & on the property
of the the Defend^t John Lishild[?] which the Plaintif John Swanson is a equally
directed by his deed of purchase & Sale to pay of and discharge and which
in our opinion the circumstances appearing in the Cause cannot be
considered as upon Mortgage for the Right and Equity of Redemption is
still remaining & thereby decreed for the said Plaintif. But as to the Intacks
& Cottage belonging to or any of them that the Plaintif is not Intitled to
them in this case, and we leave the Deft John Lishild[?] in the possession
thereof and this we give as our opinion and Judgment in the ~~Cause~~ premises.
