The Petition of Appeal of Cha: Bromfield
His Majesty's Comptroller in Castletown

Sheweth That your Petitioner in the Month of March
last applyd to John Cæsar of Ballahick for the Setting of a
House and Concerns, called Ballumurle, and accordingly
on the John Cæsars engaging, to put the said House in Good &
Sufficient Tenantable Order and Repair, and to put up a
Gate in the Court or Yard, and do other necessary Improvements,
to make the said House Commodious and Comfortable
Your Pet^r agreed and took a Setting thereof, for one Year,
from 12^th May last at the Rent of Eight Guineas.

That your Pet^r being on his Part, quite desirous
& ready to fullfill the said Agreement sent a Messenger on
purpose, to the said John Cæsar, on the said 12^th May, for the
Keys of the said House & Concerns, that so he might enter
upon the Possession thereof, but so it was, that the Keys
could not be got on that Day, and for several Days after, nor
could your Pet^r, even to this Day, get Possession thereof, properly
speaking — as the said John Cæsar totally refused on repeated
Applications, to perform the Conditions of his Agreement
or to put the said House, in habitable Order.

That your Petit^r was at length necessitated
to convene the said John Cæsar before Your Worship for the
Expences & Damages occasioned by his Neglect and
Default of not fulfilling his Agreement — And that it
appeared in Evidence taken and Sworn by and before
Your Worship, that the said John Cæsar, repeatedly refused
and particularly the 13 June last, to make the said House
Tenantable, and fit for your Petit^r to Dwell in, it being
