Copy M^r Humphreys Opinion

On the proposed Grant of Annuity from Lord Glenlyon
to The Norwich Office—

I shall observe upon the Securities proposed in the
accompanying Instructions in the order they there occur.

First— As to the Annuity of £2500 Secured to
Lord Glenlyon during the joint Lives of himself & the Duke
of Atholl by his Lordships Marriage Settlement on the Charge
created by 25 Geo: 3^d. In strictness it should be proved by
an Authenticated Pedigree, that the Duke is the Heir General
of the 7^th Earl of Derby, but as the Settlement itself (on
which occasion every necessary investigation must have taken
place) proceeds upon the assumption of this Fact, it may I
think for the present purpose be safely taken for granted.

The proposal is silent as to Lord Glenlyons life Interest
in the Parliamentary charge expectant on his surviving the
Duke on which Event the Annuity of £2500 ceases, but the
Security should extend to this also.

By the Settlement the legal Fee of the Parliamentary
charge is vested in the Trustees, Notice of the proposed
Assignment should therefore be given to the actual Trustees—
both on account of it and also in order to secure a Lien upon
any Fund to be substituted for this charge by Parliament.
The Assignment too should contain a Covenant to assign his
Lordships Interests in the Fund when Established for the
purposes of the intended Security.

Secondly.— As to the Annuity of £1000 agreed by
the Articles also executed on Lord Glenlyons Marriage to be secured
during the joint Lives of his Lordship and The Duke of Atholl
upon part of The Dukes Perth Estates which are there agreed
to be settled subject to this and another Charge on the Duke
