ANNO REGNI VICESIMO QUARTO Seſſ. 2.
titled to ſuch Permit, Two original Parts or Duplicates
thereof, One of which ſhall be intitled The Seller's Permit,
and the other The Buyer's Permit, in printed Letters; and
that the Buyer's Permit ſhall be ſent and delivered with
ſuch Spirituous Liquors unto the Buyer thereof, upon
Pain that ſuch Spirituous Liquors ſhall (if the ſame is not
ſeized in the Tranſit for Want of lawful Permit) be
forfeited to the Buyer thereof, and the Seller rendered
incapable of recovering the Value or Price thereof in any
Court of Law or Equity; and alſo, that the Seller ſhall,
over and beſides the Loſs of the ſaid Spirituous Liquor,
forfeit and loſe Double the Value thereof, including the
Duties, and that the Evidence of the Buyer, or Perſon
receiving the ſaid Spirituous Liquors, ſhall be admitted
to prove that the ſame was delivered without a lawful
Permit.

XII. Provided always, That when any Suit or Action
ſhall be commenced, or any Information brought, wherein
the Delivery or Non-delivery of any Permit to the
Buyer of any Britiſh Spirituous Liquors ſhall become a
Queſtion, it ſhall be ſufficient for the Seller to exhibit on
Proof the Permit, intitled, The Seller's Permit, for the
Removal of ſuch Britiſh Spirituous Liquors, and to
prove that there hath been a ſuitable Decreaſe in the
Seller's Stock of the Spirits mentioned in ſuch Per-
mit; and, upon the making out ſuch Proof, the Spiritu-
ous Liquor in Queſtion ſhall be adjudged to have been
ſent out and delivered with a lawful Permit, according
to the true Intent and Meaning of this Act.

XIII. Provided alſo, That no Buyer of any ſuch
Britiſh Spirituous Liquors ſhall avail himſelf of any
ſuch Forfeiture as aforeſaid, unleſs ſuch Buyer ſhall,
within fourteen Days next after the Delivery of the
ſaid Goods, exhibit his Complaint or Information upon
Oath, before the Commiſſioners of Exciſe, or Juſtices of
the Peace having Juriſdiction, and forthwith proſecute the
ſame with Effect; and when any ſuch Buyer ſhall, before
the Delivery of ſuch Spirituous Liquors, have actually paid
for the ſame, and ſhall proſecute the Seller, by Informa-
tion, for the Recovery of the ſaid Penalty of Double Value,
