(Case)

21^st May 1764 By Indenture of this date made between Peter John Heywood Esq^r & Elizabeth his Wife
of the one part and James Spedding of the other part among other Estates an Estate called the
Nunnery therein particularly described situate in the Isle of Mann for the Considera^ns therein
ment^d was limited to the said James Spedding and his Heirs Upon Trust for the said Peter
John Heywood for Life and in case the said Eliz^th Heywood sho^d survive her Husband then
as to a Moiety thereof In Trust for the said Eliz^th Heywood for Life and from and after the
decease of the said Peter John Heywood and Eliz^th his Wife the whole of the said Estate sho^d fall
and descend to their Son Thomas Heywood and his Heirs as Heirship or Inheritance
agreeable to the Law and Custom of the said Isle—

The said Thomas Heywood died several Years ago an Infant—

The s^d Peter John Heywood contracted with John Taubman for the Sale of the Est. but by
reason of the Limitations in the said Settlement such Contract could not be performed
without an Act of Parliament—

16^th Geo 3^d 1776. By an Act of Parliament for that purpose the said Estate was vested in James Spedding
and Joseph Bushby their Heirs and Assigns discharged from the uses Trusts and Limitations
in the said Indre of 21^st May 1764 and also from the Claim of any person claiming under the s^d
Peter John Heywood and Eliz^th his Wife and James Spedding Upon Trust that when
the said John Taubman sho^d have paid his purchase Money into the Bank in the name
and with the privity of the Account^t General of the Court of Chancery the said James Spedding
and Jo^s Bushby sho^d convey the said Estate unto and to the use of the said John Taubman
his Heirs and Assigns and it was further enacted that the said John Taubman sho^d pay the
said purchase Money into the Bank in the name and with the privity of the said Accountant
General separate the purchase or purchasers of the said Hereditaments and premises tho^t
sho^d there remain until some proper purchase sho^d be found and approved of as
thereinafter directed and until such Money sho^d upon a Petition setting forth such
approbation to be preferred to the Court of Chancery be ordered to be paid out of the Bank for
the Compleating such purchase And it was further enacted that the said purchase Money
sho^d as soon as conveniently might be be laid out by the said James Spedding
and Joseph Bushby with the Consent of the said Peter John Heywood and Eliz^th his Wife during
their Lives and the Life of the Survivor and afterwards of the proper Authority of the said Trustees
in the purchase of the fee Simple and Inheritance of Manors Lands Tenements or Heredits
