that no insertion thus made should subject either them or
himself to a prosecution for libel

In pursuing this course your Memorialist totally
disregarded profit, and the resentment which he incurred
from various Manks families and connections; — and from
the course he thus adopted his Print met with a totally
inadequate and profitless sale

In December 1826 an unhappy misunderstanding having
arisen between two Clergymen in the Island which became a
matter of public discussion, your Memorialist as a public Journ-
alist inserted an Advertisement brought by one of the parties
the Rev John Tithen, which subjected him(though he had previously
honourably, and conscientiously given up the Manuscript of the
author) to a prosecution for libel, and a verdict was obtained
against him for such insertion

This Verdict was obtained in August last within a few days
of the demise of the other Clergyman beforementioned the late Rev John
Christian; — subsequently to which another Prosecution has been
instituted against the said Rev John Tithen, as the author of the Ad-
vertisement herementioned, and a Verdict obtained against him also.

M^r John Christian died insolvent, and your Memorialist was
advised that with his demise the prosecution would fall to the ground;
under this impression, he appealed to the Honourable House of Keys
to have the judgment reversed; more particularly as he was informed
and verily believes, that it was owing to the ignorance of the Jury
alone, and their total incapacity to form a judgment of the law of
libel that such verdict was given; as your Memorialist has
been informed and believes that one amongst those who formed [?]
the Jury, enquired if your Memorialist was the Printer who espoused
the Lord Bishops cause against the landed interest, as in that case the
Damages should be One Hundred Pounds instead of Fifty which was
awarded.

The Appeal came on to be heard before the House of Keys
on Tuesday the 1^st December instant, when, after Counsel being heard
on both sides, the Verdict against your Memorialist was affirmed;
subjecting him to the damages of Fifty Pounds, together with all costs
amounting to nearly the sum of One hundred Pounds
