Sheweth
That your Pet^r being a Transmarine and having

which day your pet^r attended, but nothing
was done thereon at that Time by reason of the
Absence of one of the Defendants in the said

That the said Cause having been appointed to
be heard at Ballahorn on the 29^th March
1765 The Defendant Christian Kelly did then
& there exhibit a pretended Plea in the said
Cause whereto the Pet^r having craved Leave
to put in his Replication in the said Cause the
said Plea & Replication were then ordered
to come on to be argued together at a
Consistory Court held at K.K. Michael
on Monday the 15^th of April 1765,
and the pet^r attended accordingly, but
the Hearing of the said Plea & Replication
was then adjourned to a further Day and
so continued by adjournments to the 9^th day
of this Instant May, when the said Plea
of the said Christian Kelly with the Pet^rs
Replication in aid of his said Claim having
come on to be fully argued debated and
discussed before your Reverences in Court in
presence of both parties the pet^r moved
that the Benefit of the said Plea might
be saved to the final Hearing of the said
Cause without prejudice [above line: in the mean time] [and?] that the Pet^r might be at Liberty

by your hon^ble Decree Confirm the Same There
for Relief in all and Singular the Premises
