ANNO REGNI VICESIMO QUARTO Seſſ. 2.

Auditor of the Exchequer, &c. to keep the ſaid Sums apart from all other Duties, and to apply them in like Manner as the repealed Du- ties.

Exchequer, and all other Officers and Perſons concerned in the iſſuing or applying the ſaid Duties, are hereby directed and required to keep the ſaid proportional Sums diſtinct and apart from all other Duties and Revenues, and to diſtribute, iſſue, and apply the ſame to the reſpective Funds, and to ſatisfy the ſeveral Charges to which the Duties hereby repealed were applicable, together with all Arrears of the ſaid repealed Duties, in the ſame Manner as thoſe Duties have heretofore been iſſued and applied.

LIII. And whereas Arthur Forbes of Culloden, in the County of Inverneſs, Eſquire, is poſſeſſed of an Exemp= tion from the Duties of Exciſe forth of or growing due within the Lands of Ferintoſh, in the ſaid County, under a certain Leaſe, Sett, or Farm thereof, which was allowed by ſeveral Acts and Declarations of the Parlia= ment of Scotland before the Union; which Exemption hath been found highly detrimental to the Revenue of Exciſe, and prejudicial to the Diſtillery in other Parts of Scotland, and it is therefore become neceſſary that the ſame ſhould be extinguiſhed and made void, upon a ſuitable Compenſation to be made for the ſame to the Proprietor of the ſaid Lands; be it enacted, That the Lords Commiſſioners of his Majeſty's Treaſury ſhall, and they are hereby authorized and impowered to treat, contract, and agree with the ſaid Arthur Forbes upon the Amount of the Compenſation to be made in Lieu and Diſcharge of the Exemption ſo claimed, and at preſent enjoyed by him; and that, if the ſaid Lords Commiſ-

If any Agree- ment ſhall be made for ſuch Compenſa- tion, the ſame ſhall be paid by the Com- miſſioners of Exciſe in *Scot- land:*

ſioners of the Treaſury, and the ſaid Arthur Forbes, his Heirs or Aſſigns, ſhall come to any Agreement for any ſuch Compenſation, the ſame ſhall be paid by the Com= miſſioners of Exciſe in Scotland for the Time being, out of the Revenues of Exciſe under their Collection and Management, unto the ſaid Arthur Forbes, his Heirs or Aſſigns, in ſuch Manner and Form as the ſaid Lords Commiſſioners ſhall, in and by any Contract or Agree= ment, or any Warrant or Warrants under their Hands, order and direct; and the ſaid Commiſſioners of Exciſe are hereby required to make ſuch Payment accordingly; and that if the ſaid Lords Commiſſioners ſhall not be able to agree
